Lawsuit filed against US Shredder and Castings Group, Inc.
Metso Texas Shredder, Inc. (MTSI) filed a lawsuit in United States District Court in San Antonio against a former employee, William Tigner, and his current employer, US Shredder and Castings Group, Inc. (US Shredder).
The suit alleges that Tigner and US Shredder used “confidential, proprietary, and trade secret information and other company property,” obtained while Tigner was a MTSI executive, in violation of a confidentiality agreement Tigner signed.
The lawsuit seeks more than $1 million in damages as well as an injunction to stop the “unfair and illegal” practices.
MTSI alleges all of the defendants engaged in Misappropriation of Trade Secrets, Tortious Interference with Prospective Business Relations, Unfair Competition, Tortious Interference with Existing Contract, Conspiracy, Conversion, and Violations of the Texas Theft Liability Act. In addition, MTSI alleges that Tigner was in Breach of Duty of Confidentiality, Breach of Fiduciary Duties, Breach of Contract and violated the Computer Fraud and Abuse Act.
The lawsuit alleges that Tigner incorporated US Shredder while still employed by MTSI and that he solicited key MTSI employees, suppliers, and customers while he worked for MTSI and after he left the company to form US Shredder.
